1. VALIDITY OF GENERAL TERMS AND CONDITIONS
These Terms and Conditions apply to all services provided by DCC, hereafter referred to as 'Budvii', in connection with prepaid eSIM services.
These Terms and Conditions are accessible on the Budvii website and mobile app.
Budvii may consider variant clauses only in the case of explicit written agreement.
2. DESCRIPTION OF SERVICES
2.1. eSIM SERVICES
Budvii provides prepaid eSIM services to customers.
Customers can register and purchase eSIM plans through the Budvii website and/or Budvii app. Payments are processed through secure payment providers Adyen and Stripe.
2.2. REGISTRATION
Customers are required to accept Budvii's Terms and Conditions to access and use Budvii services. Registration includes providing essential information such as First Name, Last Name, and Email Address. Alternatively, we can ask for Billing Address.
2.3. Budvii COMMITMENTS
Budvii is committed to delivering quality service to customers. However, Budvii does not guarantee uninterrupted service, on-time delivery, or fault-free operation. Service interruptions may occur due to maintenance, network issues, or unforeseen circumstances.
2.4. CUSTOMER RESPONSIBILITIES
Customers using Budvii's services must not engage in abusive, illegal, or fraudulent activities. Any actions that impair or damage the network are strictly prohibited.
Budvii may suspend a customer's service if they breach these obligations. During suspension, customers must continue to fulfill all outstanding payment obligations.
2.5. DEVICE COMPATIBILITY
Customers are responsible for ensuring that their devices are eSIM compatible and network-unlocked. Device compatibility depends on factors such as the carrier, country of origin, and device type. Customers may verify their device's compatibility using Budvii's list over the app, but list is subject to change.
By confirming their device's eSIM compatibility, customers assume responsibility for the accuracy of this information.
3. SERVICE CONTRACT INITIATION, TERM, AND TERMINATION
Budvii's service contract encompasses the commencement, duration, and termination of your data plan.
3.1. CONTRACT INITIATION
Your service contract with Budvii officially commences upon the successful completion of an order and the purchase of a data plan through our website or mobile app.
3.2. CONTRACT DURATION
The duration of your contract is contingent on your active data package. As long as you maintain an active data package, your contract with Budvii remains in effect.
3.3. CONTRACT TERMINATION
Your contract with Budvii will automatically terminate under the following circumstances:
- Inactive Data Package: If you no longer have an active data package associated with your eSIM.
- eSIM Removal: When you remove the Budvii eSIM from your device.
4. CHARGES AND PAYMENT
4.1. PAYMENT CONDITIONS
Budvii supports various payment methods, including Credit/Debit Card, Google Pay, Apple Pay, but deserve right of introducing other payment methods.
All payments are in US Dollars ($).
4.2. PRICING AND CLAIMS
4.2.1. Transparent Pricing
Budvii provides transparent pricing, which includes all applicable taxes, unless otherwise specified.
4.2.2. Claims and Disputes
In the event of any disputes or claims, customers are encouraged to contact Budvii's customer support team for prompt resolution. Budvii aims to resolve issues amicably and efficiently.
Budvii values its customers and strives to address any concerns in a fair and timely manner. Customers are not entitled to offset their claims against Budvii's claims unless such claims are undisputed or have been confirmed by a final court judgment.
5. DELIVERY AND ACCESS
5.1. IMMEDIATE ACCESS
Upon completing the purchase, customers will have immediate access to their Budvii eSIM via the Budvii website or mobile app.
5.2. CONFIRMATION EMAIL
Customers will receive a confirmation email after the eSIM purchase, containing essential details regarding their order.
5.3. INSTALLATION INFORMATION
All necessary information for installing the eSIM will be available exclusively on the customer's Budvii account.
5.4. DELIVERY TIMES
Budvii aims to provide timely access to eSIMs and related services. While we strive to deliver promptly, we do not guarantee immediate availability and access, as it may depend on factors beyond our control, such as device compatibility and network conditions.
6. CANCELLATION POLICY
Budvii's cancellation policy is designed to ensure a seamless experience should you decide to discontinue your eSIM service.
6.1. CANCELLATION PROCESS
To cancel your Budvii eSIM service, please contact our support. Cancellation requests will be processed promptly.
6.2. EFFECT OF CANCELLATION
Upon cancellation, your Budvii eSIM will no longer be active, and access to your service will cease. Any remaining data or service balance will be forfeited.
6.3. NO REFUNDS FOR CANCELLATION
Please note that we do not provide refunds for unused portions of your Budvii eSIM service upon cancellation.
7. REFUND POLICY
At Budvii, we prioritize your satisfaction and aim to provide a hassle-free experience. This policy outlines the procedures for refunds related to our eSIM services.
7.1. ELIGIBILITY
You have the right to request a refund only due to the following circumstances:
- Technical Issues: If you encounter technical problems preventing the installation and use of the Budvii eSIM, and all other elements are in order.
7.2. REFUND REQUEST
To initiate a refund request, please contact our dedicated support team within thirty (30) days from the date of purchase. We encourage prompt cooperation in resolving any issues.
7.3. VALIDITY PERIOD
Please note that each data package comes with its own validity period. We do not offer refunds for the remaining data once the validity period expires or if the package is not used in total.
7.4. EXCLUSIONS
We do not provide refunds or compensation for charges incurred from alternate devices, SIM cards, providers, hotel phones, or unrelated expenses not directly associated with your Budvii eSIM usage.
7.5. FRAUD PREVENTION
Budvii reserves the right to refuse refunds in cases of abuse, violations of our Terms and Conditions, or fraudulent activity.
7.6. UNAUTHORIZED PURCHASES
Cases involving unauthorized purchases will be thoroughly investigated and require approval before processing any refund. Budvii may suspend accounts associated with fraudulent activity.
7.7. ACCIDENTAL PURCHASES
Once you install the Budvii eSIM, it is considered used, and refunds will not be issued.
7.8. DISPUTES
In cases where you reasonably and in good faith dispute an invoice or part of it, you must notify Budvii within twelve (12) days of receiving the invoice, providing details of the discrepancy.
8. MODIFICATION POLICY
Budvii's modification policy allows you to adjust your eSIM service to better suit your needs. Here's how you can modify your Budvii eSIM:
8.1. MODIFICATION PROCESS
To modify your Budvii eSIM service, simply log in to your Budvii account and access the modification feature. Here, you can make changes to your data package, or any other customizable options.
8.2. EFFECT OF MODIFICATION
Modifications to your Budvii eSIM service will take effect as specified during the modification process. Your updated service will be available for use immediately.
8.3. COST OF MODIFICATION
Please be aware that certain modifications may result in adjustments to your billing. Any additional charges will be reflected in your Budvii account.
9. DATA USAGE AND PRIVACY CONSENT
By using Budvii's eSIM service, you consent to the collection, processing, and storage of your data in accordance with our Data Usage and Privacy Policy, available on our website and mobile app. We are committed to protecting your privacy and safeguarding your information.
Budvii employs security measures to protect our network and your data. Any attempt to breach network security or engage in unauthorized access is strictly prohibited.
10. REFERRAL PROGRAM
10.1. Introduction
These Terms & Conditions ("Terms") govern your participation in the Budvii eSIM Referral Program ("Program"). By participating in the Program, you agree to comply with these Terms.
10.2. Eligibility
The Program is open to all registered users of the Budvii eSIM app.
10.3. How to Participate
- Referral Code: Share your unique referral code with friends and family.
- Referral Link: Invite others by sharing your referral link via email, social media, or other channels and platforms.
10.4. Referral Rewards
- Referrer Reward: For each successful referral, the referrer will receive 10% of the referred user's purchased package as a credit.
- Referred User Reward: The referred user will receive a 10% discount on their first purchase or a minimum of $2 if 10% of the purchased package amount is less than $2.
10.5. Successful Referrals
A referral is considered successful when the referred user:
- Is a new Budvii eSIM user and uses the referrer's unique code or link.
- Completes their first purchase successfully.
10.6. Reward Distribution
- Rewards will be credited to the referrer after the referred user completes their first purchase successfully.
- Rewards are non-transferable and cannot be exchanged for cash.
10.7. Limitations
- Participants cannot refer themselves.
- Abuse of the Program, including creating fake accounts or spamming, will result in disqualification from the Program and forfeiture of any rewards.
10.8. Termination and Changes
- Budvii reserves the right to terminate or modify the Program at any time without prior notice.
- In the case of a refund initiated for the referred user, the credit for 10% of the referred user's purchased package will be deducted from the referrer's credit.
10.9. Liability
- Budvii is not responsible for any lost, late, or misdirected referrals or rewards.
- Budvii reserves the right to disqualify any participant who violates these Terms.
10.10. Governing Law
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates.
